Terms & Conditions

1. PARTIES & SCOPE

I, the (“Participant”), understand that I am voluntarily participating in consultations, coaching sessions, breathwork sessions, breathwork immersions and trainings, and related audio or video materials (collectively, the “Activities”) offered by Psych You Should Know Pty Ltd (ABN 14631349490), trading as Psychedelic Breathwork, and its directors, facilitators, contractors, employees, and agents (collectively, the “Releasees”).

By registering for, purchasing, or participating in the Activities, or by clicking “I Accept” or “Proceed” or any clearly indicated activation phrase on my computer or other device, or using the website, I agree to the following terms.

2. SERVICES & DISCLOSURE

I understand that the Activities are designed to support self-exploration, insight, and well-being, and do not constitute medical, psychological, or therapeutic treatment, nor are they a substitute for professional medical or mental health care. I acknowledge that the Releasees do not diagnose, treat, prescribe, or cure any medical or psychological condition, and that participation in the Activities does not replace care provided by licensed health professionals.

3. MEDICAL DISCLAIMER

I understand that the Activities may involve intensive connected breathing techniques that can produce strong physical, emotional, and psychological responses, and may be physically, emotionally, or mentally demanding.

I acknowledge that participation may involve temporary physical discomfort, emotional release, psychological distress, or altered states of awareness.

4. ELIGIBILITY TO PARTICIPATE (CONDITIONAL)

I understand that participation in the breathwork related Activities is conditional upon not having any of the listed contraindications in the Health and Eligibility Declaration, unless formal clearance has been obtained in advance from a registered medical or mental health professional.

I acknowledge that the Releasees do not assess medical or psychological fitness, and that eligibility to participate is based solely on the Participant’s own disclosures and medical advice.

The Releasees reserve the right to refuse, limit, or discontinue participation at anytime, including prior to or during an Activity, if eligibility criteria are not met, required clearance has not been obtained, or participation is deemed unsafe.

5. RISKS & ASSUMPTION OF RISK

I acknowledge that participation in the Activities involves inherent risks, some of which may be known or unknown and cannot be eliminated without altering the nature of the Activities.

These risks may include, but are not limited to: physical discomfort, emotional distress, disorientation, hyperventilation, respiratory alkalosis, muscle spasms, tingling or numbness, chest discomfort, psychological distress, and risks arising from the conduct or actions of other participants.

I voluntarily assume all such inherent risks and acknowledge that my participation is entirely voluntary.

6. CONFIDENTIALITY

I understand that Activities are not recorded unless explicitly stated in advance.

I acknowledge that while ethical standards of confidentiality are maintained, confidentiality cannot be guaranteed in group settings where participants voluntarily share personal information.

I understand that confidentiality may be disclosed without consent where required by law or where there is an imminent risk of harm to myself or others.

Personal information is handled in accordance with the company’s Privacy Policy.

7. METHODOLOGY, WARRANTIES, & OUTCOMES

I acknowledge that the Releasees make no guarantees regarding outcomes from participation in the Activities, and that testimonials or examples do not constitute a warranty of results.

8. LIMITATION OF LIABILITY

To the fullest extent permitted by law, I agree that the Releasees shall not be liable for any loss, damage, or injury arising from my participation in the Activities.

Nothing in this agreement is intended to exclude, restrict, or modify any rights or remedies that cannot be excluded under the Australian Consumer Law or applicable state legislation.

9. INDEMNITY & HOLD HARMLESS

I agree to release, indemnify, and hold harmless the Releasees from any claims, losses, damages, liabilities, or expenses arising from my participation in the Activities or my interactions with other participants, except to the extent that such liability cannot be excluded by law.

10. JURISDICION

These Terms & Conditions are governed by the laws of Victoria, Australia. Each party submits to the non-exclusive jurisdiction of the courts of Victoria in relation to any dispute arising under or in connection with these terms.

11. ACKNOWLEDGEMENT & CONSENT

I confirm that I have read and understood this agreement in full, and have had the opportunity to ask questions, and voluntarily agree to its terms.

I understand that by registering, purchasing, or participating in the Activities, I am providing my informed consent.
